Sa pamilyang Filipino, ang pera ang karaniwan na nagiging ugat ng pag-aaway ng mag-asawa, magulang, anak at mga kapatid. Kung minsan, may mga asawa na gumagawa ng pagnanakaw o panloloko upang makakuha lang ng pera sa asawa, magulang, anak at mga kapatid. Kung minsan ay kasama ang mga in-laws sa mga nakawan, panloloko o pagsira ng gamit.
Ang iyong asawa, magulang, anak at mga kapatid kasama ang parents-in-law, childred-in-law and brother/sisters-in-law ay hindi pwedeng kasuhan ng criminal case na pagnanakaw o panloloko/swindling/estafa o malisyosong paninira ng gamit kung ito ay ginawa nila? Ayon sa Article 332 ng Revised Penal Code, ang asawa, magulang, anak at mga kapatid kasama ang parents-in-law, childred-in-law and brother/sisters-in-law ay exempted sa criminal liability ngunit pwede silang singilin sa perang nakuha o sa danyos na natamo.
Art. 332. Persons exempt from criminal liability. — No criminal, but only civil liability, shall result from the commission of the crime of theft, swindling or malicious mischief committed or caused mutually by the following persons:
1. Spouses, ascendants and descendants, or relatives by affinity in the same line.chanrobles virtual law library
2. The widowed spouse with respect to the property which belonged to the deceased spouse before the same shall have passed into the possession of another; and
3. Brothers and sisters and brothers-in-law and sisters-in-law, if living together.
The exemption established by this article shall not be applicable to strangers participating in the commission of the crime.
Ang exemption na ito sa criminal liability ay hindi applicable sa sinumang tao na kasama sa pagnanakaw o panloloko/swindling/estafa o malisyosong paninira ng gamit na hindi kamag-anak na nabanggit.
Ayon sa Korte Suprema sa kasong Intestate Estate of Manolita vda de. Carungcong vs. People [G.R. No. 181409, February 11, 2010], ang Article 332 ay ginawa para ipreserba ang harmony sa pamilya at maiwasan ang eskandalo, "the spirit of Article 332 is to preserve family harmony and obviate scandal."
